The Emperor's New Suit. Flush from victories over Napster and the eeeevil forces of P2P, the RIAA is now taking aim at radio. Who are they suing now? Why, XM, of course... Because XM makes available vast catalogues of music in every genre, XM subscribers will have little need ever again to buy legitimate copies of plaintiffs' sound recordings. That's right! The DJ's whim will negate my need to be in control of my listening experience! I will never need a full CD again because my every wish is fulfilled by the umpteenth repetition of "King of Pain"! I mean, come on. I love that one XM's 80s channel with all the synth new wave and none of the R&B, and the serendipity of it totally gives me pop-culture warm-fuzzies, but after awhile I'd really like to hear the entire Synchronicity album instead of whatever single the DJ has cued up. Remember how the recording industry totally fell apart when radio walkmen became available? Remember how the movie industry just died when every household got its VCR? The world will end just like that if XM is allowed to release the Inno. Just Like That! Which is to say, not much. And the RIAA knows it. XM calls this lawsuit exactly what it is: a bargaining tactic. The labels are currently in talks with XM and its rival Sirius Satellite Radio, to renegotiate digital royalty contracts for broadcasts.I'm not optimistic that an equitable agreement can be reached when one party is holding a big fat lawsuit over the other party's head to ensure their demands are met, but that's just me. Cynical.
